Sargento® Merch Privacy Policy

This Privacy Policy describes how personal information is collected, used, and shared in connection with the Sargento® merchandise store located at merch.sargento.com (the “Store”). It applies only to the Store and to purchases made through it. It does not apply to Sargento®’s primary website or other Sargento® properties, which are governed by Sargento®’s general Privacy Policy, available at https://sargento.com/legal/sargento-privacy-policy 

If you have questions about how your information is handled outside the Store — for example, on Sargento®’s main website, recipe content, or newsletter sign-ups — please refer to that general Privacy Policy instead. 

Who Is Responsible for the Store

The Store is operated on Sargento®’s behalf by Powertex Sportswear, Inc (“Powertex,” “we,” “our,” or “us”), an independent service provider. Powertex operates the Store’s checkout, order processing, account, and customer service functions, and is the party that collects and stores the personal information described in this Policy. 

Sargento® owns the Store’s branding and product designs and may receive limited summary or aggregated information about Store activity (for example, sales totals or product performance) from Powertex. Sargento® does not directly collect, store, or have access to your payment information, order history, account credentials, or shipping address through the Store. Any marketing communications you receive that relate to the Store will come from Sargento® directly, using contact information you have separately and affirmatively provided to Sargento®— the Store itself does not collect email addresses for marketing purposes and has no email sign-up function. 

Because Powertex, not Sargento®, is the business that collects and controls personal information through the Store, Powertex is identified throughout this Policy as the responsible party, and this Policy should be read as Powertex’s privacy disclosure for the Store, made on Sargento®’s behalf and with Sargento®’s approval.

Information We Collect

Information You Provide Directly

When you place an order or create an account on the Store, we collect:

  • Name, shipping address, billing address, email address, and phone number
  • Account credentials, if you create a Store account (username and password)
  • Order history and order details, including items purchased, order value, and order status
  • Customer service communications, including any messages, complaints, or requests you submit to us

We do not collect or store your full payment card number. Payment is processed through Wells Fargo’s payment processing platform. Card details are tokenized immediately upon entry; Powertex receives and stores only a payment token, the last four digits of the card, and the transaction authorization result — never the full card number, expiration date, or security code. 

Information Collected Automatically

When you use the Store, we and our service providers automatically collect certain technical and usage information through cookies and similar technologies, including:

  • Device and browser information (browser type, operating system, device type) 
  • IP address and approximate location (such as city or region) derived from it 
  • Pages viewed, links clicked, time spent on pages, and referring/exit pages 
  • Shopping cart contents and checkout progress, to allow the Store to function 

We use Google Analytics, configured under Sargento®’s Google Tag Manager account, to understand how visitors use the Store. As a result, this usage and analytics data — which is generally not by itself identifiable to you by name — is visible to and accessible by Sargento® in addition to Powertex. We do not use the Store to serve targeted or behavioral advertising, and we do not use advertising pixels (such as a Meta Pixel) or similar cross-site ad-tracking technologies on the Store. Sargento®’s receipt of Store analytics data is described further in “How Information Is Shared” below. 

How We Use Your Information

We use the information described above to: 

  • Process and fulfill your orders, including payment authorization, shipping, and order tracking 
  • Create and maintain your Store account, if applicable 
  • Respond to customer service requests and resolve order issues, including returns and refunds 
  • Detect and prevent fraud, unauthorized transactions, and abuse of the Store 
  • Maintain records required for accounting, tax, and legal compliance purposes 
  • Analyze aggregate Store traffic and performance to improve the shopping experience 

We do not use information collected through the Store to send you marketing communications, and we do not sell or share your personal information for cross-context behavioral advertising, as those terms are defined under applicable state privacy laws. 

How Information Is Shared

We share personal information collected through the Store only as follows: 

  • With Wells Fargo, to authorize and process your payment 
  • With shipping carriers, to deliver your order 
  • With Sargento®, limited to (a) aggregated or summary order data, and (b) Store analytics data collected through Sargento®’s Google Analytics/Google Tag Manager configuration, for purposes of brand reporting and Store performance review 
  • With service providers who support Store operations on our behalf, such as hosting, IT, and platform infrastructure providers, bound by contract to use the information only to provide services to us 
  • Where required to comply with a subpoena, court order, or other legal obligation, or to protect against fraud or unauthorized transactions 
  • In connection with a merger, acquisition, or sale of business assets relating to the Store 

We do not sell personal information, and we do not share personal information with third parties for cross-context behavioral advertising. We do not use the Store to serve ad-network pixels, so there is currently no sale or sharing activity occurring on the Store. As a precautionary matter, and consistent with Sargento®’s practices on its other properties, the Store nonetheless provides a “Cookie Settings” link in the Store footer and recognizes the Global Privacy Control (GPC) signal, described further below. If our practices change such that we begin selling or sharing personal information, this Policy will be updated and any additional opt-out mechanisms required by law will be implemented before that activity begins. 

Cookies

The Store uses the following categories of cookies:

We do not currently use advertising or marketing cookies on the Store. You can manage your cookie preferences at any time using the cookie settings link in the Store footer. The Store recognizes the Global Privacy Control (GPC) signal sent by your browser or browser extension and treats a GPC signal as a valid request to opt out of any sale or sharing of your personal information and to disable optional analytics cookies. You may also submit an opt-out request directly using the “Cookie Settings” link in the Store footer. Because the Store does not currently sell personal information or share it for cross-context behavioral advertising, honoring these signals currently has the practical effect of disabling optional analytics cookies; if our practices change, these same mechanisms will also govern any future sale or sharing.

Data Retention

We retain order and account information for as long as needed to fulfill your order, respond to any related customer service issues, and comply with our tax, accounting, and legal recordkeeping obligations, and then delete or de-identify it in accordance with our standard retention schedule. Payment tokens are retained only as long as permitted by our payment processor’s requirements and are not usable outside the Store’s payment system.

Data Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect your personal information, including tokenization of payment data so that full card numbers are never transmitted to or stored by the Store. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Categories of Personal Information We Collect, Disclose, and Sell

This section supplements the disclosures above and identifies the categories of personal information the Store has collected, disclosed for a business purpose, and sold or shared, within the preceding twelve (12) months, using the categories defined under the California Consumer Privacy Act (CCPA). The Sargento® Merch Store does not sell or share personal information for cross-context behavioral advertising, its data practices differ from those of Sargento®'s primary website. Personal information does not include publicly available information, deidentified or aggregated information, or information excluded from the CCPA’s scope (such as information governed by HIPAA, the Gramm-Leach-Bliley Act, or the Fair Credit Reporting Act). We do not collect full payment card numbers; card data is tokenized by our payment processor, Wells Fargo, immediately upon entry.

Your Privacy Rights

Depending on where you live, you may have the right to:

  • Know what personal information we have collected about you and request a copy of it
  • Request that we delete your personal information
  • Correct inaccurate personal information
  • Receive your personal information in a portable, commonly used, machine-readable format (data portability)
  • Opt out of the sale or sharing of personal information, or targeted advertising. As described above, the Store does not currently sell or share personal information, but you may still submit an opt-out request at any time using the "Cookie Settings" link in the Store footer, or by enabling a Global Privacy Control signal in your browser
  • Limit our use and disclosure of your sensitive personal information to uses necessary to provide the services you requested. To exercise this right, click the "Cookie Settings" link in the Store footer or contact us using the methods below.
  • Appeal a denial of your privacy request. To appeal, contact us using the methods below and include "Privacy Appeal" in the subject line. We will respond within the timeframe required by applicable law.
  • Not be discriminated against for exercising these rights

We will verify your request before responding and will respond within the timeframe required by applicable law. An authorized agent may submit a request on your behalf where permitted by law. 

Changes to This Policy

We may update this Policy from time to time to reflect changes in our practices or for legal or operational reasons. Material changes will be posted on the Store prior to taking effect.
